Colorado Meth Project Inc. (DBA “Rise Above Colorado”) is committed to protecting your privacy. We have prepared this Privacy Policy to describe to you our practices regarding the Personal Data (as defined below) we collect from users of our website, located at www.riseaboveco.org (“Site”), and Services (as defined in the Terms of Service). Capitalized terms not defined in this Privacy Policy have the meanings given in our Terms of Use.

1. Information You Provide to Us.
We may collect certain personally identifiable information from you in various ways when you use the Site (“Personal Data”), including your first and last name, gender, e-mail and mailing addresses. In situations where you order items or materials from us, we will collect billing and shipping information if different from your mailing address. We have various programs allowing users to share personal narratives, photos, or videos, (“Narratives”) and in addition to collecting the Narratives themselves, we may collect additional Personal Data about you related to the Narratives.

If you are making a purchase on the Site, we may also ask you to provide credit card information. In such event, it is our policy to redirect you to a payment processing portal hosted by a third party payment processor. We do not collect, access, store or process any credit card information. Please read the privacy policy on our payment processor’s website regarding the use, storage and protection of your credit card information before submitting any credit card information.

When you participate in one of our surveys, we may collect additional profile information.

We may also collect Personal Data, such as at other points in our Site that state that Personal Data is being collected.

2. Information We Collect via Technology.
To make our Site and Services more useful to you, our servers (which may be hosted by a third party service provider) collect information from you, including your browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit. We also use spotlight tags to gather information regarding the date and time of your visit. A “spotlight tag” is a mechanism that allows us to track whether you have been served one of our advertisements on a third party website. In some cases, this information may be combined with Personal Data.

3. Information Collected from Social Networking Service.
If you access the Site from a social networking service (e.g., Facebook or Twitter), or interact with us through social media services, we may receive Personal and/or Anonymous Data about you from such social networking site, in accordance with the terms of service and privacy policy of the third party provider of such social networking service. We may add this information to the information we have already collected from you via the Services.

4. Use of Your Personal Data.
Personal Data you submit to us is used either to respond to requests that you make, or to aid us in serving you better. We use your Personal Data in the following ways: identify you as a user in our system; provide improved administration of our Site and Services; provide the Services you request; improve the quality of experience when you interact with our Site and Services; send you administrative e-mail notifications, such as security or support and maintenance advisories; respond to your inquiries related to volunteer or employment opportunities or other requests; to make telephone calls to you, from time to time, as a part of secondary fraud protection or to solicit your feedback; and to send newsletters, surveys, offers, and other promotional materials related to our Services and for other marketing purposes of Rise Above Colorado.

5. Disclosure of Your Personal Data.
We disclose your Personal Data as described below and as described elsewhere in this Privacy Policy.

a. Information Disclosed to Third Party Service Providers. We may share your Personal Data with third party service providers to: provide you with the Services that we offer you through our Site, such as the creation of ads for our messaging campaign; to conduct quality assurance testing; to provide technical support; or as otherwise necessary to These third party service providers are required not to use your Personal Data other than to provide the services requested by Rise Above Colorado.

b. Affiliates and Acquisitions. We may share some or all of your Personal Data with our state Meth Project affiliates or other entities under a common control (“Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy. If another entity acquires our organization or our assets, that entity will possess the Personal Data collected by us and will assume the rights and obligations regarding your Personal Data as described in this Privacy Policy.

c. With your permission as part of a Narrative. As part of certain programs and Services, we may, with your permission, share Personal Information and Narratives about you with other users of the Services or with the general public, in accordance with the guidelines we provide at the time the information is collected as part of the Service. For example, we may collect stories of recovery from users to share on our website or through other programs to help and inspire others. If you do not wish to have your Narrative shared with others, please do not submit it to us for consideration. If you later decide you would prefer that a Narrative you have shared should not be public, we may not be able to make the Narrative non-public.

d. Other Disclosures. Regardless of any choices you make regarding your Personal Data (as described below), Rise Above Colorado may disclose Personal Data if it believes in good faith that such disclosure is necessary (angel) in connection with any legal investigation; (beer) to comply with relevant laws or to respond to subpoenas or warrants served on the Rise Above Colorado; (c) to protect or defend the rights or property of Rise Above Colorado or users of the Services; (d) to protect you or any other person in the event physical harm is threatened; and/or (e) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or Terms of Service.

6. Creation of Anonymous Data.
We may create Anonymous Data records from Personal Data by excluding information (such as your name) that make the data personally identifiable to you. We use this Anonymous Data to analyze request and usage patterns so that we may enhance the content of our Services and improve Site navigation .Rise Above Colorado reserves the right to use Anonymous Data for any purpose and disclose Anonymous Data to third parties in its sole discretion.

7. Third Party Sites.
When you click on a link to any other website or location, you will leave our Site and go to another site and another entity may collect Personal Data or Anonymous Data from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content.

8. Your Choices Regarding Your Personal Data.

a. Choices. We offer you choices regarding the collection, use, and sharing of your Personal Data. We will periodically send you free newsletters and e-mails that directly promote the use of our Site or Services. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly (please see contact information below). Despite your indicated e-mail preferences, we may send you service-related communications, including notices of any updates to our Terms of Service or Privacy Policy. Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Site.

b. Changes to Personal Data. You may request deletion of your Personal Data by us, but please note that we may be required to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives. We may retain your information for fraud or similar purposes. Where we have shared a Narrative and associated Personal Data publicly, we will delete your Personal Data upon request, but cannot require other parties who may have reproduced the information to delete it.

9. Security of Your Personal Data.
We take reasonable organizational, technical and administrative steps to help protect Personal Data against loss, misuse, unauthorized access or disclosure. Unfortunately, no transmission or storage system can be guaranteed to be completely secure, and transmission of information via the internet is not completely secure

10. Your California Privacy Rights
If you are a California resident, you have the right to request information from us regarding the manner in which we share certain categories of Personal Data with third parties for their direct marketing purposes. As described in Section 5(a), above, Rise Above may share information with Affiliates for marketing purposes. You may request a list of the Affiliates with whom Rise Above has shared your information about has implemented such a policy and does not share your Personal Data with any third parties for their direct marketing purpose.

11. Privacy Rights of Children
Rise Above generally does not collect information about children under the age of 13. When we intend to collect Personal Data from children under the age of 13, we notify parents about the information we intend to collect, including the uses of the information and whether we intend to share the information; obtain, where appropriate and consistent with law and our privacy practices, consent from parents for the collection, use and sharing or Personal Data regarding their children; limit the collection of data to that which is reasonably necessary to participate in the Services; and allow the parent to request deletion and correction of data as appropriate.

13. Changes to This Privacy Policy.
This Privacy Policy is subject to occasional revision, and if we make any material changes in the way we use your Personal Data, we will notify you by prominently posting notice of the changes on our Site. Any changes to this Privacy Policy will be effective thirty (30) calendar days following our posting of notice of the changes on our Site. These changes will be effective immediately for new users of our Site or Service. Continued use of our Site or Service, following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.

14. SPECIAL NOTE TO INTERNATIONAL USERS.
The Site is hosted in the United States. You are prohibited from providing any Personal Data from any physical locations within the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws. To the extent you provide Personal Data through the Site despite the foregoing, you are transferring your Personal Data to the United States and you consent to:

a. such transfer, and potential further transfer to other parties who are also in the United States, as set forth elsewhere in this Privacy Policy,

b. the application of the laws of the United States and/or the State of Colorado with respect to any dispute arising from or related to the Privacy Policy and/or your use of the Site, other than such rules, regulations, case law, and/or international treaties that would result in the application of the laws of a jurisdiction other than the United States or the State of Colorado, and

c. the exclusive jurisdiction of the courts of the State of Colorado and the federal courts sitting in Denver, Colorado.

Any claim or dispute between you and us that arises from your use of the Site or in connection with the Privacy Policy shall be decided exclusively by a court of competent jurisdiction located Denver, Colorado, U.S.A. You agree that such court shall have personal jurisdiction over you, you agree to submit to the jurisdiction and venue of such courts, and you waive any objection based on inconvenient forum.
